Our mission is to provide secure means of communicating for people who value their privacy. To do that, we need to collect, use, and share some of your personal information. This Privacy Policy is meant to help you understand how AMS does that and how to exercise the choices and rights you have in your information.
The Content of this Policy
The Scope of This Policy
This policy applies to all AMS users and their Recipients. This policy applies only to personal information, not to aggregate information or information that does not identify you. Please remember that your use of Encrypt-Decrypt.com (Platform)is also subject to our Terms of Service. Certain elements of the Platform may operate under separate or additional terms or practices different from or in addition to those described in this policy; in those cases, you will be provided separate notice and information relevant to your use of those parts of the Platform.
The Information We Collect
When you use the Platform, we collect the information you provide, usage information, and potentially device information. We may also collect information about you from other sources like service providers, and optional programs in which you participate, which we may combine with other information we have about you. Here are the types of information we collect about you:
A. Information You Provide to Us
Account Registration. When you create an account, we collect the information you provide us, such as your name, email address, phone number, and payment information. We may ask you for additional information, which you may choose to provide to us from time to time. We may ask that you provide additional information related to the identity of your account, such as documents related to identification (e.g., driver’s license).
Ratings and Feedback. We may ask you to rate and provide feedback about the Platform, when we do, we will store the feedback information you provide.
Communications. When you contact us or we contact you, including through surveys or research projects, we collect any information that you provide, including the contents of the messages or attachments you send us.
B. Information We Collect When You Use the Platform
Location Information. The Platform collects location information (which includes your IP address, and possibly the mapping of your IP address to your location).
Device Information. We do or may in the future collect information about the devices you use to access the Platform, including device model, IP address, type of browser, version of operating system, identity of carrier and manufacturer, radio type (such as 4G), preferences and settings (such as preferred language), application installations, device identifiers, advertising identifiers, and push notification tokens.
Communications Between Users and Recipients (who are also Users). we collect information about communications between users and may record. We also may store Platform chat information between Users and AMS Customer Service agents, including the participants’ phone numbers, the date and time, and the contents of SMS, email, and chat messages, if and when we start such a service. For security purposes, we may also monitor and we do record the contents of messages made through the Platform, and may not inform you specifically when we do.
Cookies, Analytics, and Third-Party Technologies. We do not presently use Cookies but may in the future collect information through the use of “cookies”, tracking pixels, data analytics tools like Google Analytics, SDKs, and other third-party technologies to understand how you navigate through the Platform. We have no Advertisements.
C. Information We Collect from Other Sources
Service Providers and Other Parties. Service providers and other parties provide us with information needed for core aspects of the AMS Platform, as well as for additional services, programs, and processing that can enhance your AMS experience. These service providers and other parties include credit card processing providers, and other businesses. We obtain the following information about you from these parties:
Stripe Credit Card Processing: When you enter credit card information on this site, it transmits directly with Stripe and is not stored on this system. In other words, this site does NOT store your Credit Card Number, its Expiration Date, your Zip code, or your CVC (security code) number. This site does receive certain reference numbers that identify your credit card transaction as a “customer” and for the “charge.” These numbers are not identifiable to you personally, but are used for crediting a refund later, when applicable. We do store the amount of the transaction, the month and year, and other information that might be needed to communicate with a User about their charge.
How We Use Your Information
We use your personal information to provide the AMS Platform with the following:
• Maintain the security and safety of the Platform and its users;
• Build and maintain the AMS community;
• Provide customer support;
• Improve the AMS Platform; and
• Respond to legal proceedings and obligations.
• Provide an intuitive, useful, efficient, and worthwhile experience on our platform;
• Verify your identity and maintain your account, settings, and preferences;
• Calculate deposits, refunds, and process payments;
• Allow Users and Recipients to connect and share their Messages;
• Communicate with you about your use of the Platform and experience;
• Collect feedback regarding your experience;
• Authenticate and verify users;
• Find and prevent fraudulent or illegal use;
• Block and remove unsafe, criminal or fraudulent users from the AMS Platform.
• Personalize and provide content, communications, and targeted promotions to grow the AMS Platform; including sending SMS Messages and
Emails to Users and Recipients to advise them of the status of their registration and messages
• Providing Customer Support and responding to Users.
• Investigate and assist Users in resolving questions or issues regarding the AMS Platform;
• Perform research, testing, and analysis;
• Develop new products, features, partnerships, and services;
• Prevent, find, and resolve software or hardware bugs and issues;
• Monitor and improve our operations and processes, including security practices, algorithms, and other modeling;
• Respond to Legal Proceedings and Requirements. Sometimes the law, government entities, or other regulatory bodies impose demands and
obligations on us with respect to the services we seek to provide. In such a circumstance, we may use your personal information to respond to those demands or obligations.
• We may share Personal Information when required to do so to comply with any applicable federal, state, or local law or regulation, civil,
criminal or regulatory inquiry, investigation or legal process, enforceable governmental request, or requirement as condition to operate (e.g., operating permit, license or agreement);
• Respond to legal process (such as a search warrant, subpoena, summons, or court order);
• Enforce our Terms of Service;
• Cooperate with law enforcement agencies concerning conduct or activity that we reasonably and in good faith believe may violate federal,
state, or local law; or
• Exercise or defend legal claims, protect against harm to our rights, property, interests, or safety or the rights, property, interests,
or safety of you, third parties, or the public as required or permitted by law.
• In Connection with Sale or Merger: We may share your personal information while negotiating or in relation to a change of corporate
control such as a restructuring, merger, or sale of our assets.
How We Share Your Information
We do not sell your personal information to third parties for money -- no one can buy the personal information we collect from and about you and we do not act as a data broker. We do NOT trade personal information with third-parties. However, we only share your personal information with other users, third parties, and service providers when necessary to make the Platform work and to deliver relevant services to you on and off the AMS Platform. We only share your information, which you have provided to us with the understanding that we will share it with your Recipients – those you have invited to trade messages with. This section otherwise explains when and why we share your information.
A. Sharing Between AMS Users
Recipients. A Recipient is a person your invite to join you in sending messages to each other. When you invite a person to be a Recipient, the Platform sends that person an email to the email address you provide as a User. The email informs them that you have invited them (your name appears) and gives them a link that, when clicked on, will display the page for them to Register as a User. Once they Register, you will receive an email notifying that they are ready to received Messages from you. Once you are connected, you may send messages back and forth with them.
User Message Notifications. When a message has been encrypted and is ready for you to retrieve and read it, you will receive an email notifying that a Message is waiting and who created the Message, with a link to login. When you login, you will be able to retrieve and read that Message.
B. Sharing with Service Providers to Provide the AMS Platform, and Other Parties
AMS may share the following categories of your personal information to provide you with a variety of the AMS Platform’s features and services:
This Platform is hosted on a Virtual Private Server that is maintains and operated by Hostek, a world-renown server provider based in Tulsa OK. Founded in 1998k they have data centers in six locations across the world. They are scalable and reliable.
This platform runs on a Private Server on the Unix operating system, with numerous security features including separate packages added by AMS. All transmissions are made under a Secured Socket Layer (SSL) that encrypts communications going from or to the server from a Browser. Most Browsers handle SSL. (If yours does, you will see a small lock symbol at the start of the browser search bar area.) If you don’t see the lock symbol, do not use encrypt-decrypt.com. Our server code is also encrypted.
We do not provide any information to any other third-party, only to/from Users and their Recipients. The Personal Information we collect at Registration includes your name, email address, and phone number. We do not share phone numbers between Users and Recipients. We only share information between Users and Recipients as needed. We do NOT collect date of birth, government identification number (such as social security number), or driver’s license information. We do collect credit card information, but that is instantly transmitted to Stripe, a third-party provider, and not stored on the Platform. All personal information stored on this Platform is encrypted.
We do or may in the future collect and store Internet or other electronic network activity information, such as your IP address, type of browser, version of operating system, and carrier and/or manufacturer, device identifiers. From this information we may be able to derive limited location data (e.g., country). This system is limited to use ifrom IP addresses originating in the United States.
C. Upon Your Further Direction
With your written permission or upon your direction, we may disclose your personal information to interact with a third party or for other purposes.
How We Store and Protect Your Information
We retain your information for as long as necessary to provide you and our other users the AMS Platform. This means we keep your profile information for as long as you maintain an account. We retain transactional information such as payments for up to seven years to ensure we can perform legitimate business functions, such as accounting for tax obligations. We also retain your information as necessary to comply with our legal obligations, resolve disputes and enforce our terms and policies. If you request account deletion, we will delete your information as set forth in the “Deleting Your Account” section below. We retain Messages for about 90-days, and we retain Acknowledgements (where you agreed to our policies and terms) indefinitely.
We take reasonable and appropriate measures designed to protect your personal information. But no security measures can be 100% effective, and we cannot guarantee the security of your information, including against unauthorized intrusions or acts by third parties.
Your Rights and Choices Regarding Your Data
As explained more below, AMS provides ways for you to access and delete your personal information as well as exercise applicable data rights that give you certain control over your personal information.
A. All Users
You can always delete your account. Deleting your account will NOT delete certain history needed for tax, operational or other reason deemed necessary by AMS Management. The information that you cannot delete include our record that your acknowledged our policies and terms, and records of past payments and refunds. Deleting your account will erase your messages, your archived messages, your Recipient Pairings, and User Record. Any deposit balance at time your User Record is deleted will be refunded to your last charge, if valid.
Emails. You can NOT unsubscribe from Platform emails. Such messages are Operational in nature and provide no means to unsubscribe. The Platform will send you transactional and relational emails about your use of the AMS Platform when appropriate.
Text Messages. We do not send commercial or promotional text messages by texting. We do send SMS messages to your phone as part of our 2FA (Two Factor Authentication) when you are logging-in. You cannot opt oout of these Operation texts, unless you delete your account, which you can do at any time. It is the User’s option as to whether the Platform uses an SMS or an Email message for validation during login in. If your phone lacks the ability to receive a Text Message, simply opt for an email.
Push Notifications. You can opt out of receiving push notifications through your device settings. Please note that opting out of receiving push notifications should not impact your use of the Platform.
Profile Information. You can review and edit certain account information you have chosen to add to your profile by logging in to your account settings and profile. You can change your email address or your phone number at any time.
Accessing Your Information and Deleting your Account. If you would like to access your personal information, please visit the Platform main menu, after login, where there is a button to “Manage my Account.” You can modify your Personal Information there.
Deleting Your Account. In some cases, the Administrator may delete your account, in its sole-discretion and without prior notice, such as if there is an issue with your account related to trust, safety, criminal behavior, payment, or fraud. When we delete your account, we may retain certain information for legitimate business purposes or to comply with legal or regulatory obligations.
B. Recipients
When you delete yourself as a User, your stored data related to your association with other User(s) as a Recipient are deleted too. When you were invited as a Recipient by a User a "Pairing" record was created. Once created, that "Pairing" works in either direction between you, as a Recipient, and the User who invited you (same as if you invited that User as your Recipient). Deletion of the User record by either party will delete the Pairing record, so no messages will be able to be sent in either direction.
Children’s Data
AMS is not directed to children, and requires a person who is registering to acknowledge that they are at least 18 years of age. We don’t knowingly collect personal information from children under the age of 18, and if such is discovered, the Administrator will take steps to delete that information. If you believe that a child under the age of 18 has given us personal information, please contact us (see below).
Links to Third-Party Websites
The Platform may contain links or references to third-party websites, products, or services. Those third parties may have privacy policies that differ from ours. We are not responsible for those third parties and their websites, products or services, and we recommend that you review their policies. Please contact those parties directly if you have any questions about their privacy policies.
Changes to This Privacy Policy
We may update this policy from time to time as the Platform changes and privacy law evolves. If we update it, we will do so online, and if we make material changes, we will let you know through the Platform or by some other method of communication like email. When you use AMS, you are agreeing to the most recent terms of this policy. If you have checked all of the Acknowledgements, and we make a change to this policy, by continuing to use the Platform, you are acknowledging acceptance of the new policy.
